Required HIP contents – leaseholds
This Fact sheet is up to date at January 2009
The contents of the HIP, both compulsory (Required) and voluntary (Authorised), are set out in the regulations contained in Statutory Instrument 2007 No 1667 as varied by a number of amending statutory instruments.
For a leasehold property, there is just one further Required element in addition to those required for all properties (see Fact sheet 2). originally the following (that have now been relegated to the Authorised category were also 'Required'-
Any regulations that affect the property or building of which it forms part Service charge information for the previous 36 months Most recent request for service charge, ground rent, insurance for previous 12-month period Name and address of current/proposed landlord Name and address of current or proposed managing agents Details of any proposed changes to the lease or the regulations A summary of works being or proposed to be undertaken that affect the property or the building of which it forms part with the actual or estimated cost; the contribution expected due from the lessee; actual or estimated date the works will be completed and the actual or estimated date when any contribution will be required from the lessee.
Although this information is no longer 'Required', the Property Information Questionnaire cover s some of these topics. So, owners of leasehold properties are advised to retain all information, demands etc they receive from the landlord or managing agents. Otherwise they may need to obtain copies, for which an additional charge might be made, to answer addtional queries from a buyer.
